TERMS AND CONDITIONS: "Customer" is referred here as the person requesting production services from Gus Figuerola dba American Pictures and whose name appears above in PRODUCER'S FULL NAME and/or BUSINESS NAME of this contract. 1. A 50% deposit is required to reserve the date unless the customer has been exempted from this requirement due to previous contract work. The remaining balance is due in full at the end of the shoot unless customer has approved terms. This 50% deposit is non-refundable and non-transferrable if the video shoot is cancelled or postponed for any reason. American Pictures reserves the date and time agreed upon and will not make any other reservations for this time and date. 2. A $45 surcharge is applied to all customer accounts on approved credit terms  if payment is postmarked after the due date. Interest charges of 23.8% per year will also apply.  Customer agrees to pay all legal fees, attorney's fees and collection costs incurred by American Pictures in the event American Pictures is forced to collect on any delinquent amount owed by the customer for services rendered under this contract. 3. American Pictures shall not be liable for any damages arising from any sort of personal injury or property damage sustained by any person(s) in or about the area of the video production from any acts of American Pictures or its agents. Prior to the shoot, as an option, American Pictures will make its general liability insurance available to the customer for an additional fee. 4. The customer understands that, under any and all circumstances, American Pictures' liability is limited to the refund of all monies paid by the customer to American Pictures for production services rendered under this contract. 5. American Pictures will bill the customer 100% of the total amount stipulated under this contract if the video shoot is cancelled or postponed for any reason with less than a 24 hour notice. If the video shoot is cancelled or postponed for any reason with less than a 48 hour notice, American Pictures reserves the right to apply a cancellation fee of 75% of the total amount. If after cancellation by the customer, American Pictures is able to provide its production services to another client on the cancelled date(s), then American Pictures, at its own discretion, may waive the cancellation fee to the customer. 6. The expected total cost under this contract does not include overtime, toll and mileage charges (if any), parking expenses, expendables, travel expenses, meals, videotape stock and other miscellaneous expenses normally associated with a video production shoot and which is the responsibility of the customer/producer. 7. A full production day is described here as an eight hour day. The production day starts counting immediately upon arrival of American Pictures at the shooting location and ends after American Pictures has completely left the location premises. Overtime starts accruing after this eight hour period at a rate specified by American Pictures and ends correspondingly upon complete departure of the location premises.
